General Terms & Conditions

About these Terms and Conditions

In these Terms and Conditions "we" and "us" mean the Commonwealth Scientific and Industrial Research Organisation (CSIRO) ABN: 41 687 119 230 and "you" and "your" means you the customer.

These Terms and Conditions apply to your use of the Parkes Observatory shop website (www.parkesdishshop.com) and you agree to comply with them as a condition of use.  If you do not agree to them in their entirety, you are not permitted to use or access any of the material on the website.

Where you submit an order to us, these Terms and Conditions together with the order confirmation you receive from us constitute the entire contract between us for the supply of the ordered products.  Except as set out below, no other terms or conditions will apply. 

These Terms and Conditions may only be varied in writing.  No CSIRO Parkes Radio Telescope Visitors Discovery Centre employee or agent has the authority to vary any of the Terms and Conditions.

Placing Your Order

You may place your order by filling in the order form on this website. When you place your order, we will issue you with an order number. We will do this by email. By placing an order, you make an offer to us to purchase the products you have selected based on these Terms and Conditions.

We will confirm acceptance of your order when we send you an email confirming shipment of the products you have ordered.  No contract is formed between us for the supply of the ordered products until we have confirmed our acceptance and shipment of the order.

If we cannot process or accept your order after payment is received, we will contact you by email or telephone.  We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion by notifying you.

Payment Methods and Processing

We accept Visa and MasterCard payments only.  Payment processing will not begin until we receive all the information we need to process your order.  Orders placed on a weekend or a public holiday will not begin payment processing until at least the next business day.  Business days are Monday through Friday, excluding NSW public holidays.  We process credit card payments after you click the "Submit My Order" button. For credit card payments we will email a tax invoice to you with your order confirmation.

All prices quoted on this website are inclusive of GST except for items that are exempt from GST. Items that include GST, and the total GST paid will be clearly marked on the invoice.

Delivery Charges

We reserve the right to change prices for delivery at any time prior to confirmation of shipping.  Delivery charges for orders to be sent outside Australia are always subject to confirmation prior to shipping.

Delivery Times

Products will not be shipped until after you receive confirmation of shipping from us.  Delivery times will vary depending on the method of shipping.  Although every effort is made to ship your order according to any estimated delivery times provided, this time may change due to changes in supply or circumstances beyond our control.   If your Product has not arrived after the estimated delivery time, please email us at parkes-vdc@csiro.au.

Generally orders will be shipped to you by Australia Post, depending on the size of the products, by either Express or Registered Post.  CSIRO may choose a more appropriate courier service of our choosing in some instances. 

We recommend that someone be present at the nominated delivery address between the hours of 9.00am and 5.00 pm in order to collect and/or sign for your delivery (depending on the method of delivery, packages may be left at the address or may require a signature to collect).

Products Damaged in Transit

Title and risk of loss to all products will pass to you on shipment. 

Once purchases have been dispatched, we cannot be held responsible for items lost or damaged in transit.  If this occurs, please call the courier's customer service team or you can email us at parkes-vdc@csiro.au and we will put you in contact with them. 

If you would like to arrange separate insurance for your products with Australia Post or the relevant courier we can provide you with the relevant contact details to facilitate this.

Faulty Products

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

While we will endeavour to supply you with the products your have ordered in acceptable condition, on occasion products may be faulty as a result of a manufacturing defect from our suppliers. If this occurs please either email us at parkes-vdc@csiro.au or contact our Customer Service Team. We will supply you with a refund or a replacement product on return of the faulty product.  All shipping costs for the original and any replacement products are your responsibility.

Limitation of Liability

Without limiting these Terms and Conditions, to the maximum permitted by law, we exclude all liability in respect of your purchase of products from the website and will not be liable for any losses, damages, costs or other consequences resulting directly or indirectly from your purchase of the products.

We reserve the right to amend or supplement these Terms and Conditions without prior notice.  You should review these Terms and Conditions on each occasion before using or accessing the website, or placing an order.

General

You may not assign any rights and obligations under these Terms and Conditions whether in whole or in part without our prior written consent. Any unauthorized assignment shall be deemed null and void.

If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales (NSW), Australia and shall be subject to the non-exclusive jurisdiction of the courts of NSW.
